Federal judge rules the BOTS Act applies to Ticketmaster

A federal judge rejected Ticketmaster's motion to dismiss the FTC's lawsuit against it, ruling that the BOTS Act can absolutely be used to hold ticketing platforms accountable, not just individual resellers, as Ticketmaster had argued. The ruling does not mean the FTC has won the case, only that it has stated valid legal claims sufficient to proceed to discovery. The judge cited an internal Ticketmaster email in which a senior executive admitted the company looks the other way at broker conduct "as a matter of policy," and pointed to evidence that Ticketmaster has actively reduced or discontinued tools that could have enforced ticket purchase limits.

New York AG sues Evolutions Festival over $264K in missing refunds

New York AG Letitia James filed suit against the organizers of Evolutions Festival alleging they collected more than $264,000 in ticket sales and vendor fees for the 2025 festival, canceled it ten days before it was scheduled to begin, and never refunded anyone. The festival blamed the venue for failing to secure permits; the AG's office alleges the organizers knew the venue had issues as far back as July, were running low on cash by August, and told investigators they would only issue refunds if they won a separate lawsuit against the venue, which directly conflicts with New York law. James is seeking full restitution, $5,000 in civil penalties for each of the 1,185 alleged violations, and a requirement that the organizers post a $500,000 performance bond before holding any future events in New York.

Nashville Symphony suspends season until Oracle saves the day

The Nashville Symphony declared a "financial emergency" on September 28, suspended its 2026-27 season, and announced furloughs for all 77 orchestra members and 27 full-time staff; citing a $10 million operating deficit and a financial structure the board described as "unsustainable for years." Six days later, Oracle stepped in with a $10 million donation, reinstating the season and canceling all furloughs. Oracle's CEO tied the gift to the company's new Nashville East Bank headquarters: "We are here to help solve the community's problems and ensure Nashville remains a vibrant place to live and work."

The season resumes October 16.

Live Nation backs Creator Nation to acquire and scale creator management firms

Live Nation has provided a capital commitment to Creator Nation, a new company led by husband-and-wife co-founders Scott and Alexis Fisher that will acquire and grow creator management agencies and adjacent businesses. Creator Nation will support creators across content, commerce, brand partnerships, and live experiences, with the first acquisitions expected before the end of the year. For Live Nation, the investment is a bet that creators with large audiences are the next generation of touring acts, and that getting in at the management layer is the most efficient way to own that relationship before it reaches the arena.

The industry unites to push for prison time in the first AI streaming fraud case

The Music Fights Fraud Alliance, whose members include Spotify, Amazon Music, Meta, Merlin, Empire, Downtown, DistroKid, and dozens more, submitted a letter to the sentencing judge in the Michael Smith streaming fraud case, arguing for a significant prison sentence to "signal to the public the actual legal consequences of streaming fraud." Smith, a North Carolina man who used AI-generated tracks and bot accounts to steal more than $8 million in streaming royalties over six years, pleaded guilty to wire fraud conspiracy in March and is scheduled to be sentenced October 6.

Backstreet Boys sell 450,000 tickets for their Germany homecoming 🇩🇪

The Backstreet Boys opened a 10-night residency at Düsseldorf's Merkur Spiel-Arena with 450,000 tickets already sold, their only European shows of 2026. Germany was the first country to give the group a platinum certification, for their 1996 single "I'll Never Break Your Heart." The residency follows their sold-out Sphere Las Vegas run, which moved 900,000 tickets across 54 shows. Düsseldorf hotels were 94% booked for each opening night, up from around 57% for the same dates last year, and the city organized 1990s-themed parties and pop-up experiences around the run.

Zach Bryan and Shakira set records on the same night

October 3 was a record-setting night, both in person and online. Zach Bryan set an attendance record at Gillette Stadium on Saturday night, playing to 73,538 fans in Foxborough, MA. Shakira also set a record on the same night in Madrid, Spain. Her concert was the most-viewed livestream by a female artist on Amazon Music, ever. Numbers were announced, but Shakira added another show to the residency on October 12 as a result.

OVG sues Dallas and Fair Park First for more than $20 million

Oak View Group has filed a lawsuit in Texas Business Court against the City of Dallas and nonprofit Fair Park First, seeking more than $20 million after the city terminated OVG's contract to manage Fair Park in June 2025. OVG alleges Dallas misrepresented the condition of Fair Park's infrastructure during procurement, withheld operating funds, slashed promised capital improvement budgets, redirected restricted donor funds, and made "intentional and malicious" false statements that damaged the company's reputation. The filing claims OVG invested $1 million of its own money, grew annual park revenue by more than 200%, and saved the city's general fund more than $40 million in operating costs over its tenure.

LA28 torch relay will visit all 50 states, starting in Atlanta

LA28 announced that the 2028 Olympic Torch Relay will begin in Atlanta - home of the last US Summer Games in 1996 - and travel through all 50 states before reaching the Opening Ceremony in Los Angeles, making it the first Olympic torch relay in history to visit every US state. The flame will be lit in Olympia, Greece before arriving in Atlanta in spring 2028; the full route will be announced in 2027. A torch relay passing through 50 states means 50 separate local activation opportunities over the course of several weeks, a meaningful commercial inventory for the organizing committee.
